These Terms of Service (“Terms”) govern your access to and use of the Startmoto website, checkout flow, digital course materials, and related services. By accessing the site, placing an order, or using any course content, you agree to be bound by these Terms. If you do not agree, you must not use our services.

Subject to full payment and ongoing compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the purchased course content for your personal, non-commercial use only. Course access is delivered digitally, typically by email or another access method designated by us.

All content on this website, including but not limited to text, graphics, logos, images, audio, video, course materials, software, and the overall design and layout, is the property of ANY PLACE ANY TIME LTD or its licensors and is protected by copyright, trade mark, and other intellectual property laws. The Startmoto name, logo, and related marks are trade marks of ANY PLACE ANY TIME LTD. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited licence described in section 3.

5. Orders, Pricing, and Payment

All purchases are subject to our Payment Policy and Refund & Cancellation Policy. By submitting an order, you represent that all information provided is accurate, complete, and current, and that you are authorised to use the chosen payment method.

6. Digital Content and Your Cancellation Rights

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a 14-day cooling-off period during which you may cancel an online purchase. However, because our products are digital content that is supplied immediately upon payment confirmation:

Digital content must be of satisfactory quality, fit for a particular purpose, and as described. If it is not, you may be entitled to a repair, replacement, or refund. 8. Acceptable Use and Conduct

You must use the site and course materials lawfully and in good faith. You must not misuse the service, interfere with its normal operation, or use the content in a way that infringes our rights or the rights of others.

9. Suspension and Termination

We may suspend, restrict, or terminate your access, with or without notice, where we reasonably believe that you have breached these Terms, engaged in fraudulent activity, circumvented access controls, initiated an abusive chargeback, or used the service in a way that exposes us, other users, or our providers to legal or operational risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Startmoto shall not be liable for any indirect, incidental, special, consequential, or punitive losses, including loss of profits, loss of opportunity, loss of data, or business interruption arising out of or in connection with your use of the site or course content.

Our total aggregate liability to you in respect of all claims arising out of or in connection with a purchase shall not exceed the amount paid by you for the relevant order.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other matter that cannot lawfully be excluded or limited under applicable law, including your statutory rights under the Consumer Rights Act 2015.

You agree to indemnify, defend, and hold harmless ANY PLACE ANY TIME LTD, its directors, officers, and employees from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your misuse of the service, or your violation of any applicable law. This obligation does not apply to the extent that the claim arises from our own negligence or wilful misconduct.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, government action, internet or telecommunications failure, payment-processor outage, cyber attack, or other force majeure event.

13. Changes to Services and Terms

We may update these Terms, course descriptions, platform features, or service availability from time to time. Where changes are material, we will take reasonable steps to publish updated terms on the site and, where appropriate, notify users using the contact details associated with their purchase. Continued use of the service after updated Terms take effect constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, this does not affect any mandatory consumer protection provisions of the law of the country in which you are habitually resident.

15. Complaints and Dispute Resolution

If you have a complaint about our service, please contact us first at info@startmoto.co.uk so we can try to resolve the issue. We will acknowledge your complaint promptly and aim to provide a substantive response within 14 business days.

If we are unable to resolve your complaint to your satisfaction, you may be entitled to use an alternative dispute resolution (ADR) service. You may also contact your local Citizens Advice bureau or Trading Standards office for further guidance.

16. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Waiver

No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy prevent further exercise of that or any other right or remedy.

18. Entire Agreement

These Terms, together with our Privacy Policy, Payment Policy, Refund & Cancellation Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and ANY PLACE ANY TIME LTD in relation to your use of this website and supersede all prior agreements and understandings. Nothing in these Terms affects your statutory rights as a consumer.
